Hacking Case Law in the Eye

Despite rampant hacking cases in Indonesia, but according to research data Cybercrime Unit V & IT Criminal Investigation Police, only two cases of successful hacking exposed and processed to the court, the case of hacking websites General Elections Commission (KPU) in 2004 and the Golkar Party website hacking case in 2006.

Both of these cases have attracted public attention because either coincidentally or not, both at two websites and political institutions are, indeed, the term hacking widely known. KPU website hacking case by Dani Firman of Yogyakarta, while Golkar Party website hacking case by Iqra Intercession of Batam.
In his research, Head of IT & Cybercrime Unit V Criminal Investigation Police Police Commissioner Peter Reinhard Golose revealed that the police as law enforcement officers are not well prepared to deal with cases of this kind in the virtual media. In fact, according to data from the Association of Indonesian Internet Service Provider (APJII) itself, in the year 2003 has recorded 2267 cases of accident and the network in 2004 there were 1103 such cases. As a result, these cases are not much addressed explicitly by the authorities.
According to Peter, the handling of cases of cybercrime itself is associated with the system to improve the quality of human resources in policing itself. "We should not only create a proficient police computer but how to create a skilled police investigate computer-related crimes," said Peter in exposure dissertation in front of the nine-member team of testers at UI Depok Convention Center on Saturday (7/6).
Peter confessed, society itself is now moving towards digital and online, but in fact the law enforcement officers themselves have not much to understand about digital evidence, a cyber crime evidence that his form is not visible because the form data. Therefore, Peter recommends special education at the Police Academy, the school police and College of Police (PTIK) the ability to explore the cyber world and synergize the use of software and hardware in cybercrime investigations.
"We also have to give sense to the employer, the importance of this, it is partnering with external stakeholders, such as Microsoft and law enforcement agencies within or outside the country to carry out training," said Peter.
Rampant cases of transactional issues facing the world, and Indonesia is now pushing the handling of cases is often called cybercrime requires a large umbrella to crack down on the criminal perpetrators. Until now it is still legal in the form of the bill.
Commissioner Peter Reinhard Golose that today, Saturday (7/6), recently earned a doctorate in science police said the Law on Information and Electronic Transactions (ITE Law) are not strong enough to bring the perpetrators to justice. "Actually a lot of weaknesses in the Act ITE. In fact there has been no material legal provisions that expressly regulate cybercrime, "said Peter after declared entitled to his doctorate by the nine members of the test team trial at UI Depok Convention Center on Saturday (7/6).
Legal provisions which expressly includes the cyber world is urgent because, according to Peter in many aspects of community life continues to move toward online. Even if there is evil in the cyber world, his form is not visible and difficult to prove. "The Internet now touches everyone's life, second life with the Internet, such a transaction. Imagine as in Estonia, hacked because, for one day all activity stops, "said Peter, who focused his research on hacking.
In Indonesia, only two cases were tried hacking, website hacking case that the General Elections Commission (KPU) is handled by the Jakarta Police and the Golkar Party website hacking case by IT & Cybercrime Unit V II Eksus Criminal Police Directorate. Golkar own website hacked by a man from Batam named Iqra Intercession.
The interpretation of the laws and the characteristics of a typical hacking unlike conventional crime is a challenge for investigators in conducting investigations. Because the form of invisible crime, hacking is borderless, transnational and paperless since all traces only stored in computers and networks in the form of log files.
Therefore, in his dissertation, Head of IT & Cybercrime Unit V Criminal Investigation Police Police Commissioner Peter Reinhard Golose stated that investigators need to apply the principles and management functions that are typical in the investigation. With the management of criminal investigations hacking, inquiry management process can continue up to the trial stage. "Currently there is no implementation of the Act relating to hacking," said Peter, in his presentation before the nine-member team of testers at the Convention Center, University of Indonesia (UI), Saturday (7/6).
Management Peter mentioned hacking consists of reception reports, assignment, planning, implementation and adjustment, control and evaluation, delivery of results, assistance in court and legal documentation. Legal documentation itself is considered very important as a material consideration in the planning of the investigation in the case of hacking in the future. Through an analysis of the management of the research cycle, Peter said that criminal investigations hacking specific characteristic, which is done by using information technology, knows no borders (borderless) and cross border (transnational), and do not leave a trail of physical documents ( paperless) but in the form of data (log files).
In the investigation, the investigator needs to explore cyberspace, even undercover on the Internet (virtual undercover) to find the hacker and the need for the existence of digital evidence such as log files that provide information in the form of notes to the command or message to the victim server to indicate the IP (internet protocol) address of the hacker. In addition, the computer needs special handling as a crime scene.
According to Prof. Dr. Sarlito W. Sarwono, Psi, as promoter Peter said that research on cyber crimes committed Peter by taking case study criminal investigations by the Golkar Party website hacking Unit V & IT Criminal Investigation Police Cybercrime is the first cyber crime investigation in Indonesia, even probably in Asia.
